Supreme Court to Weigh Legality of Trump Move to Limit Birthright Citizenship

December 7, 2025

The U.S. Supreme Court on Friday agreed to decide the legality of former President Donald Trump’s directive aimed at restricting birthright citizenship, a key and controversial part of his immigration agenda.

The high court will consider an appeal from the Justice Department following a lower court’s ruling that blocked Trump’s executive order. The order instructed federal agencies not to recognize the citizenship of children born in the United States if neither parent is a U.S. citizen or a legal permanent resident, commonly known as a “green card” holder.

The case challenges a constitutional provision dating back to the 19th century, which has long been interpreted to grant citizenship to anyone born on U.S. soil. A ruling in favor of the administration could fundamentally reshape American immigration and citizenship law.

No timeline has been set for the Supreme Court to hear arguments or issue a decision, but the case is expected to draw national attention given its potential impact on millions of children born in the U.S. to non-citizen parents.
